been a busy week for the Valley City Police Department. An incident involving a pair of handcuffs has led to a federal lawsuit against Valley City, two of its police officers and a Valley City man.

The complaint filed by Cheryl Schultz lists Mark McDonald, David Swenson, Curtis Faul and the city as defendants in the federal lawsuit.

Valley City Attorney Russ Myhre said, he can’t comment on the lawsuit until the city has formally been served with the papers. Myhre told newsdakota.com that the police officers will remain on duty and that with a lawsuit like this the city will refer the case to the North Dakota Insurance Reserve Fund attorney to avoid any conflict of interest.

Cheryl Schultz claims she suffered permanent injuries when she was handcuffed after being arrested for DUI on March 7, 2009. One of the handcuffs got stuck and police unsuccessfully tried to use bolt cutters to remove it. The cuff was taken off using an electric grinder which caused second-degree burns. Schultz is seeking more than $50,000 in damages.

And earlier this week the city reinstated Officer Randy Schmitz after a preliminary B-C-I investigation found no reason not to reinstate the officer over an altercation that occurred between him and a woman at a Valley City establishment on February 26.

Interim Police Chief Mark McDonald told newsdakota.com earlier this week that that case remains under investigation.
