N.D. (AP) – North Dakota’s Supreme Court says people who support abolishing property taxes can’t enforce state laws against illegal campaigning.

The Empower the Taxpayer group is backing Measure 2. It’s a constitutional amendment to abolish property taxes. The measure is on the ballot for Tuesday’s statewide election.  

The group sued Tax Commissioner Cory Fong and other public officials. The group claims opponents of Measure 2 are lying about its potential effects – and they’re illegally spending taxpayer money to fight it.

The Supreme Court’s ruling Thursday says North Dakota’s law against illegal campaigning can only be enforced by prosecutors. The court says there’s no provision for private lawsuits to enforce the law.

A district judge dismissed the lawsuit in April. Thursday’s Supreme Court ruling upholds that decision.
