N.D. (NewsDakota.com) – Attorney General Wayne Stenehjem has found that the Griggs County Commission failed to follow proper procedure before proceeding into an executive session.

A request was received by Stenehjem asking whether the Griggs County Commission violated the law by failing to follow proper procedure before proceeding into an executive session. Stenehjem also looked at whether the executive session held during the same meeting on February 19th was authorized by law.

Stenehjem found that the Commission failed to announce the topic it would be considering in the executive session or the legal authority for closing the meeting.

“The Commission must amend its February 19, 2016, meeting minutes to include the
specific topic and authority for convening in an executive session. Failure to take the corrective measures described in this opinion within seven days of he date this opinion is issued will result in mandatory costs, disbursements, and reasonable attorney fees if the person requesting the opinion prevails in a civil action,” Stenehjem states in his report.
