VALLEY CITY, N.D. (Valley News Live) – A domestic violence incident in Valley City ended with the suspect being arrested after he threatened to “knock out” a police officer.

According to court documents, Valley City Police responded to a report of a female who had been assaulted around 2:20 A.M. on July 5 in the 600 block of 8th Avenue SW. When an officer arrived on scene, they talked to a woman outside who was still on the phone with dispatch. She told police that Carlos Martinez Jr. had assaulted a woman who was still inside with him. The officer entered the building and announced himself to no response. He did, however, hear a man and woman crying in a bedroom. The officer says he drew his taser by this point and on his third time announcing himself, a woman told him to come in. As he walked into the bedroom, he found Martinez and the victim in a walk-in closet. He asked what was going on, which Martinez replied “nothing”. The officer told Martinez to step away from the victim and had him stand by the bedroom door.

According to court documents, the victim had blood on her lip and noticeable swelling on the bridge of her nose. The officer instructed her to stay in the closet as they waited for another officer to get to the scene so they could talk to them separately. At that point, court documents say Martinez began to exhibit aggressive behavior towards the officer. He pointed his taser at Martinez and told him to back away or he’d be tased. Martinez continued to yell and curse at the officer and told him to put the taser down and took off his shirt.

At that point the officer fired two taser probes at Martinez, one into upper left chest and another above his belly button. Martinez immediately experienced a muscle lockup and fell backwards into the wall and then between the wall and a chair.

Martinez was handcuffed as another officer arrived on scene. Court documents say he cooperated at first but began to thrash around on the floor and kick when they attempted to double-lock the handcuffs. He kicked one of the officers in the leg and the other in the abdomen. He continued to yell and curse at officers as he was escorted out of the apartment.

Martinez faces charges of Domestic Violence- Bodily injury, Assault on a Peace Officer, Preventing arrest, and violation of order prohibiting contact.
