
JAMESTOWN, N.D. (Valley News Live) – A Jamestown man is facing felony charges after allegedly asking a coworker to hack into a security system as part of a plot to take his brother’s life.
According to court documents obtained by Valley News Live, an employee from the Rail Serve Corporation contacted the Stutsman County Sheriff’s Office on September 10, saying that his supervisor, Kelly Spivey, asked him to hack into his estranged brother’s computer.
The employee, who had previously told Spivey that he went to school for computer programming and cyber security, said Spivey told him he believed that his brother had been stealing from their father as the power of attorney.
Specifically, Spivey asked the employee to gain access to his brother’s security system so he could find out when his brother would be home alone so Spivey could kill him. Spivey then gave the employee a note with his brother’s name, his wife’s name, his email account, phone numbers, and his home address. A detective confirmed that the note did, indeed, have the brother’s information.
During the investigation, a separate employee reported that a few weeks earlier, saying Spivey had looked upset. When he asked what was wrong, Spivey told him that he was going to kill his brother. He believed that Spivey was serious about the threat, according to court documents.
Detectives contacted Spivey’s brother and informed him about the threat. The brother said he was very concerned about the threat and believed Spivey to be a member of the Pagan Outlaw Motorcycle Club. He also told investigators that he believed the threat on his life to be valid.
Kelly Spivey was interviewed on September 11. He admitted he asked his employee if he would be able to hack into his brother’s computer if he provided his brother’s information. He denied telling his employee that he was going to use this information to assist in killing his brother. He said he wanted to gain access to his brother’s home surveillance system so he could see his father on camera because he hasn’t seen him in three years.
Spivey is charged with criminal attempt – murder, computer fraud, computer crime, criminal attempt, and terrorizing. He has a preliminary hearing scheduled for October 1.
