City, N.D. – City Attorney Russell Myhre has filed a response to the Writ of Prohibition in the on-going dispute over the firing of Valley City Police Chief Dean Ross.

Myhre says the city commission has already complied with the legal requirements to proceed with an administrative hearing over 18 non-criminal counts against Ross alleging misappropriation and misapplication of funds, insubordination and poor management of the police department.

On September 13, the district court entered an order, prohibiting the city from proceedings on the Ross termination hearing until after a district court hearing on October 21 to show cause as to why the city should not be ordered to desist from the proceedings on the “Statement of Charges” against Ross.

Myhre says the court record shows the city was not given notice of the court action until after it had entered the order.

The U-S Constitution provides that everyone is entitled to have notice for a hearing whenever a court acts on something involving your basic rights, said Myhre. He says this is wrong, and we are asking the southeast judicial district court to vacate its order immediately.

Myhre says the city commission has already complied with every aspect of the law to hold a hearing on the allegations against Ross.

Meanwhile the city commission will vote on Monday to approve ratifying the “Statement of Charges” against Dean Ross as directed by Commission President Bob Werkhoven and move forward to schedule a hearing in front of the board of city commission at 8am, Monday, September 26.

Ross was suspended without pay on September 9.
