N.D. (NewsDakota.com) A judge has ruled that the case against a Fort Ransom woman accused in the death of her infant son should proceed.

29-year-old Jodi Lindvall was originally charged with murder and child abuse for the death of 22-month-old Bentley Lindvall, who died on September 22, 2012.

Lindvall’s Defense Attorney Kent Marshall disputes several points in a Forum Newspaper article on February 27.

Lindvall told authorities her son hit his head while she was struggling to change his diaper. But Marshall says that point in the article is false.

Marshall says it’s up to the state to prove Lindvall guilty and he doesn’t believe they have a strong case against her. Marshall says the defense is confident that a jury will find Lindvall innocent of the murder charge.

Prosecutors say an autopsy determined the boy had been physically abused and died of a head injury.

Southeast Judicial District Judge Jay Schmitz ruled there’s probable cause for the murder case, but dismissed child abuse charges. The arraignment for Lindvall is scheduled March 6.
